RAWBOT’S TERMS OF USE

Article 1: Scope of application

Subject to the provisions of the General Regulations of the Bank, the present terms of use apply to any natural or legal person using the Rawbot service.

Article 2: Purpose

These articles define the terms of use of the Rawbot service, including the rights and obligations of the users and of the Bank in the context of the use of this service.

Article 3: Description of the service

The Rawbot is a virtual assistant accessible on the website, www.rawbank.com, and the Internet messaging tools (social networks). The Rawbot service allows users to receive direct support for all questions related to the various products and services offered by the Bank.

For the Bank's customers, the Rawbot service also provides access to their bank account information such as balance, transaction history and other banking services.

Article 4: Accessibility of the service

In addition to the website, the Bank makes the Rawbot service available to users through various Internet messaging tools.

To access the Rawbot service through Internet messaging tools, the user must have an account on the relevant messaging system.

For users who hold accounts in the Bank's books and who request to consult their account information, the Rawbot service uses the identifier of the connected account to identify the user in the Bank’s database. The identifier can be the telephone number or the e-mail address depending on the messaging system used.

To this end, the customer authorises the Bank to link all their accounts to their telephone number or e-mail address registered in the Bank’s database.

The user, holder of an account in the Bank’s books, must ensure that their information is up to date in the Bank's database and communicate any changes to the Bank as soon as possible.

The user acknowledges that in addition to these terms of use, the terms of use governing the messaging service through which they use the Rawbot service also apply.

 

Article 5: Availability of the service

The Rawbot service is available seven days a week and twenty-four hours a day. The service may, however, be interrupted for maintenance purposes without notice to users. The Bank does not therefore guarantee uninterrupted accessibility of the service.

Article 6: Guarantee of information

The Bank makes every effort to provide correct and up-to-date information through the Rawbot.

The Bank reserves the right to change the information provided by the Rawbot at any time and without prior notice to the customer or prospect, for good cause.

The Bank will not be responsible for the quality of the content of the service, for any loss or damage of any kind that may result from the use of the service.

Article 7: Liability

Except in the case of negligence, gross negligence or intentional misconduct on its part, the Bank shall not be liable for any direct or indirect damage caused to the client or prospect as a result of the use or inability to use the Rawbot.

The user is solely responsible for the preservation of the tool by which he/she accesses the Rawbot service. He/she is responsible for taking all necessary measures to preserve access to his/her phone(s), tablet(s), computer(s) of which he/she is the sole owner. He/she is fully responsible for the consequences of the disclosure of information received through Rawbot.

Article 8: Termination

The Bank reserves the right to terminate the service at any time.

Article 9: Protection of personal data

Any information transmitted when using the Rawbot service that contains, in any way whatsoever, elements recognized by law or jurisprudence as being related to private life or having a personal character or data allowing the identification of individuals and/or third parties may only be used for the sole purpose of managing the relationship with customers or prospects or any other purpose explicitly provided for at the time of its communication.

Article 10: Amendment

RAWBANK reserves the right to modify the present conditions of use at any time. However, in the event of modification, this will be brought to the attention of the users by e-mail, sms or any other means within a period of one month before it comes into force.

Article 11: Applicable Law and Dispute Resolution

The present conditions are governed by Congolese law.

Any dispute arising from these conditions that is not amicably resolved will be subject to the exclusive jurisdiction of the courts of the Democratic Republic of Congo.

Article 12: Entry into force

This agreement comes into force on the date of joining the Rawbot service.
